Agreement to Terms

Welcome to Bakamal. These Terms of Service ("Terms") govern your access to and use of our website bakamal.com and our services, including software development, cloud services, IT consulting, and related offerings.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

We reserve the right to modify these Terms at any time. Your continued use of our services following any changes constitutes acceptance of those changes.

Our Services

Bakamal provides professional technology services including but not limited to:

• Custom software development and application development
• Cloud services and infrastructure management
• Microsoft Dynamics 365 implementation and consulting
• Cybersecurity services and solutions
• Data analytics and business intelligence
• Managed IT services and support
• Digital transformation consulting

Specific services, deliverables, timelines, and pricing will be outlined in separate service agreements or statements of work ("SOW") between Bakamal and the client.

User Responsibilities

By using our services, you agree to:

• Provide accurate and complete information when requested
• Maintain the confidentiality of any account credentials
• Notify us immediately of any unauthorized access or security breach
• Use our services only for lawful purposes
• Not interfere with or disrupt our services or servers
• Comply with all applicable laws and regulations
• Respect intellectual property rights

Prohibited Activities

You may not use our services to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Engage in fraudulent or deceptive practices
• Harass, abuse, or harm others
• Collect personal information without consent
• Interfere with the proper functioning of our services

Intellectual Property

All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, icons, images, software, and code, are owned by Bakamal or our licensors and are protected by copyright, trademark, and other intellectual property laws.

For custom development projects:

• Ownership of deliverables will be specified in the applicable SOW or service agreement
• Pre-existing intellectual property remains with its original owner
• Bakamal retains the right to use general knowledge, skills, and experience gained during projects

Payment Terms

Payment terms for our services are as follows:

• Fees and payment schedules will be outlined in individual service agreements
• Invoices are due within 30 days of issue unless otherwise specified
• Late payments may incur interest charges
• All fees are non-refundable unless otherwise stated in the agreement
• We reserve the right to suspend services for overdue accounts

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our services are provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim

Some jurisdictions do not allow limitations on implied warranties or liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Bakamal and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of our services, violation of these Terms, or infringement of any third-party rights.

Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including:

• Breach of these Terms
• Non-payment of fees
• Conduct that we believe is harmful to our business or other users
• Request by law enforcement or government agencies

Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of Islamabad, Pakistan.

Dispute Resolution

In the event of any dispute, we encourage you to contact us first to seek a resolution. Most disputes can be resolved informally. If we cannot resolve a dispute informally, both parties agree to attempt mediation before pursuing formal legal action.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
